These terms govern your use of the Pando Certification website and certification services.

By accessing or using the Pando Certification website (openpando.com) or any of our certification services, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.
If you are entering into these Terms on behalf of an organisation, you represent that you have authority to bind that organisation, and "you" refers to that organisation.
If you do not agree with these Terms, please do not use our website or services.
Pando Certification provides independent third-party certification services against recognised textile and fibre standards including, but not limited to, GOTS, OCS, RCS, GRS, CCS, and OEKO-TEX® Standard 100.
The scope, conduct, and fees for certification services are governed by a separate Certification Agreement entered into with each client. These Terms apply to website use and general service enquiries. In the event of conflict, the Certification Agreement prevails.
Pando reserves the right to refuse or withdraw certification at any time where eligibility criteria are not met, where fraud or misrepresentation is identified, or where the integrity of the certification process is at risk.
All content on the Pando website — including text, graphics, logos, icons, images, and software — is the property of Pando Certification or its content suppliers and is protected by applicable intellectual property laws.
You may not reproduce, duplicate, copy, sell, or exploit any part of our website or services without our express written permission.
Use of certification marks: Upon successful certification, clients are granted a limited, non-exclusive, non-transferable licence to use the applicable certification mark in accordance with the relevant standard's mark usage guidelines. This licence is valid only for the duration of active certification and may be revoked if certification is suspended or withdrawn.
Violation of these obligations may result in suspension or termination of access to our services and, where applicable, withdrawal of certification.
Scope Certificates and Transaction Certificates issued by Pando are published in our public online registry as required by the applicable certification standards. By applying for certification, you acknowledge and consent to this public disclosure.
Certificate information published in the registry includes: organisation name, facility address, certified scope, standard and version, certificate number, validity period, and status.
Certificates remain the property of Pando Certification. Upon suspension or withdrawal of certification, the certificate must no longer be used and any references to active certification must be corrected promptly.
Certification fees are set out in our current fee schedule, available upon request. Fees vary depending on the standard, scope, facility size, and audit complexity.
Invoices are payable within 30 days of issue unless otherwise agreed in your Certification Agreement. Late payments may result in suspension of certification services.
All fees are exclusive of applicable taxes unless stated otherwise. Pando reserves the right to update its fee schedule with reasonable notice.
Both parties agree to treat as confidential any non-public information received from the other party in connection with the certification process.
Certification outcomes, certificates, and audit findings that are required to be publicly disclosed under applicable standards are not treated as confidential.
Our website and services are provided on an "as is" and "as available" basis. Pando makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Certification by Pando does not constitute a guarantee that certified products are free from defects, or that certified organisations will always comply with all applicable laws and regulations. It represents a point-in-time assessment of conformity with the applicable standard.
We do not warrant that our website will be available uninterrupted, error-free, or free from viruses or other harmful components.
To the maximum extent permitted by applicable law, Pando Certification shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with these Terms or use of our services.
Our total aggregate liability for any claims arising under or in connection with the certification services shall not exceed the total fees paid by you to Pando in the twelve months preceding the claim.
Nothing in these Terms limits liability for fraud, gross negligence, or any other liability that cannot be excluded by law.
You may terminate your use of our website at any time. Termination of a Certification Agreement is governed by the terms of that agreement.
Pando may suspend or terminate your access to our services immediately if you breach these Terms, fail to pay fees, or if we reasonably suspect fraud or misrepresentation.
Upon termination of certification, all rights to use certification marks cease immediately.
Provisions of these Terms that by their nature should survive termination (including intellectual property, confidentiality, disclaimers, and liability limitations) will remain in effect.
These Terms are governed by and construed in accordance with the laws of Vietnam, without regard to conflict of law principles.
Any dispute arising from or related to these Terms shall first be attempted to be resolved through good faith negotiation. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the courts of Ho Chi Minh City, Vietnam.
For clients in the European Union, nothing in these Terms affects your statutory rights under EU consumer protection laws.
Pando reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a new effective date.
Your continued use of our website or services after the effective date of any changes constitutes your acceptance of the revised Terms.
